再婚后付不起抚养费怎么处理 |

法律分析：根据我国法律规定，离婚后不履行抚养义务的一方，同样需要承担未成年子女的抚养费用。离婚后又再婚，生活困难可以申请减少抚养费。在司法实践中，就抚养费的变更多以增加为主，请求减少抚养费的较少，且请求减少支付抚养费有明确的法律依据。但根据公平原则、情事变更原则，在司法实践中，当事人举证证明本人的生活境遇发生变化，无实际支付能力，可以诉求减少或中止抚养费的支付。子女抚育费的数额，可根据子女的实际需要、父母双方的负担能力和当地的实际生活水平确定，有特殊情况的，可适当提高或降低上述比例。

子女抚育费的数额，可根据子女的实际需要、父母双方的负担能力和当地的实际生活水平确定。
有固定收入的，抚育费一般可按其月总收入的百分之二十至三十的比例给付。负担两个以上子女抚育费的，比例可适当提高，但一般不得超过月总收入的百分之五十。
无固定收入的，抚育费的数额可依据当年总收入或同行业平均收入，参照上述比例确定。
有特殊情况的，可适当提高或降低上述比例。
