《中华人民共和国公务员法》
第三十八条 公务员职务实行选任制和委任制。领导成员职务按照国家规定实行任期制。
第四十条 委任制公务员遇有试用期满考核合格、职务发生变化、不再担任公务员职务以及其他情形需要任免职务的，应当按照管理权限和规定的程序任免其职务。
