问题	用人单位拖欠薪资的法律规章
释义	依据《劳动法》的相关内容规章，薪资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的薪资。依据《违反和解除劳动合同的经济补偿办法》第三条，用人单位克扣或者无故拖欠劳动者薪资的，以及拒不支付劳动者延长工作时间薪资报酬的，除在规章的时间内全额支付劳动者薪资报酬外，还需加发相当于薪资报酬百分之二十五的经济补偿金。所以如果公司长期扣押薪资不发给员工可以要求让公司立即支付拖欠的薪资并支付相当于拖欠薪资总额百分之二十五的经济补偿金。
