释义	单位或个人签发空头支票或者签发与其预留的签章不符的支票，不以骗取财物为目的的，由中国人民银行处以票面金额5% 但不低1000元的罚款;持票人有权要求出票人赔偿支票金额2% 的赔偿金。屡次签发空头支票的，银行有权停止为其办理支票或全部支付结算业务。根据《行政处罚法》和《票据管理实施办法》的规章，中国人民银行是空头支票的处罚主体，银行机构发现空头支票行为的，应积极向中国人民银行分支机构举报，并协助送达相应的行政处罚法律文书。
