释义	诉讼时效已过，不一定会败诉，因为当事人还没有提出诉讼时效的抗辩，人民法院不应当就诉讼时效做出解释，并主动适用诉讼时效判决。依此可以胜诉。【法律依据】《民事诉讼法解释》第二百一十九条，当事人超过诉讼时效期间起诉的，人民法院应予受理。受理后对方当事人提出诉讼时效抗辩，人民法院经审理认为抗辩事由成立的，判决驳回原告的诉讼请求。
