释义	律师分析: 形式审查是指行政机关仅对申请材料的形式要件是否具备进行的审查，即审查其申请材料是否齐全，是否符合法定形式。法律依据: 《中华人民共和国商标法》第二十八条对申请注册的商标，商标局应当自收到商标注册申请文件之日起九个月内审查完毕，符合本法有关规定的，予以初步审定公告。第二十九条在审查过程中，商标局认为商标注册申请内容需要说明或者修正的，可以要求申请人做出说明或者修正。申请人未做出说明或者修正的，不影响商标局做出审查决定。
