公司不按规定悬挂营业执照是要承担法律责任的。公司不按规定悬挂营业执照，由公司登记管理部门予以警告并责令改正部改正的，工商行政管理部门将对其处以 2000元以下的罚款外，公司作为企业法人，擅自复印营业执照的，有工商行政管理部门收缴复印件，予以警告并处以2000元以下的罚款。
法律依据：
《中华人民共和国公司登记管理条例》 第七十三条 规定未将营业执照置于住所或者营业场所醒目位置的，由公司登记机关责令改正不改正的，处以1000元以上5000元以下的罚款。
