法定节假日加班300%工资是另付2倍还是3倍

法律主观：
可以这样说。 因为根据 劳动法 规定， 法定节假日 期间 加班 的，按日常 工资 标准的三倍支付工资。 但是需要注意的是"另外支付"，因法定休假日属有薪日，故加上本数，工作一日实际得4倍工资。法定节假日本是有薪日，劳动者即使在家休息不加班，也是有“1倍”工资的，加班的3倍工资基于加班行为产生，不应当包含本薪。
法律客观：
根据《关于职工工作时间有关问题的复函》第4条规定：法定休假日安排劳动者加班工作的，应另外支付不低于工资的百分之三百的工资报酬，一般不安排补休。
