释义	起诉离婚中，一审判决不准离婚的情况下，主张离婚的一方可以提起上诉，通过二审人民法院重新判决。上诉是当事人的基本权利。因此，当事人无需任何理由都可以提起上诉。如果二审人民法院维持原判，当事人还可以通过申诉途径要求重新判决。但是，因离婚案件可以在判决不准离婚后6个月内再提起起诉，司法实践中，对再次起诉离婚的，人民法院经调解无效都会准许离婚，因此，判决不准离婚不必进行申诉程序。
