实习期算工龄吗？ |

法律分析：在实习期用人单位与学生不存在劳动关系，不能计算工龄。学生参加跟岗实习、顶岗实习前，职业学校、实习单位、学生三方应签订实习协议。用人单位自用工之日起即与劳动者建立劳动关系，开始计算工龄。所谓工龄，是指职工自与单位建立劳动关系起，以工资收入为主要来源或全部来源的工作时间。对计算社会保险待遇有法律意义的只是连续工龄和缴费工龄。入职实习期工资的计算方式是，不能低于公司同岗位的最低档工资或者劳动合同约定工资的百分之八十，也不能低于当地的最低工资的标准。具体的薪资数额，由公司与员工协商约定。
法律依据：《中华人民共和国社会保险法》 第五十八条 用人单位应当自用工之日起三十日内为其职工向社会保险经办机构申请办理社会保险登记。未办理社会保险登记的，由社会保险经办机构核定其应当缴纳的社会保险费。自愿参加社会保险的无雇工的个体工商户、未在用人单位参加社会保险的非全日制从业人员以及其他灵活就业人员，应当向社会保险经办机构申请办理社会保险登记。国家建立全国统一的个人社会保障号码。个人社会保障号码为公民身份号码。
