释义	法律分析：企业向个人借款的借据有效。但如果存在下列情形的，则企业涉嫌非法集资和发放贷款，借据是无效的：1、企业以借贷名义向职工非法集资；2、企业以借贷名义非法向社会集资；3、企业以借贷名义向社会公众发放贷款；4、其他违反法律、行政法规的行为。法律依据：《中华人民共和国民法典》第一百四十三条具备下列条件的民事法律行为有效：（一）行为人具有相应的民事行为能力；（二）意思表示真实；（三）不违反法律、行政法规的强制性规定，不违背公序良俗。
