超市被起诉卖假货侵权怎么办 |

法律分析：侵权是指未经商标权人许可，在相同或类似商品上使用与其注册商标相同或近似的商标，或者其他干涉、妨碍商标权人使用其注册商标，损害商标权人合法权益的其他行为。侵权人通常需承担停止侵权的责任，明知或应知是侵权的行为人还要承担赔偿的责任。情节严重的，还要承担刑事责任。、
（1)责令立即停止销售;
(2)收邀并销毁侵权商标标识;
(3)消除现存商品上的侵权商标;
(4)收缴直接专门用于商标侵权的模具、印板或者其他作案工具;
(5)如果采取前四项措施不足以制止侵权行为的，或者侵权利行为与商品难以分离的，责令并监督销毁侵权商品;
(6)根据情节处以侵权所获利润五倍以下的罚款。
法律依据：《中华人民共和国民事诉讼法》
第十七条基层人民法院管辖第一审民事案件，但本法另有规定的除外。
第十八条中级人民法院管辖下列第一审民事案件：
(一)重大涉外案件;
(二)在本辖区有重大影响的案件;
(三)最高人民法院确定由中级人民法院管辖的案件。
第一百一十九条起诉必须符合下列条件：
(一)原告是与本案有直接利害关系的公民、法人和其他组织;
(二)有明确的被告;
(三)有具体的诉讼请求和事实、理由;
(四)属于人民法院受理民事诉讼的范围和受诉人民法院管辖。
