释义	法律分析：无论退休返聘人员是与单位签了1年以上合同，还是兼职，双方属劳务关系，单位都不需要再考虑要为退休返聘员工缴纳社保的。如果达到法定退休年龄没有缴满法定年限，返聘人员要自己缴纳至法定年限，单位无需再为其缴纳社保五险。法律依据：《中华人民共和国社会保险法》第二十七条参加职工基本医疗保险的个人，达到法定退休年龄时累计缴费达到国家规定年限的，退休后不再缴纳基本医疗保险费，按照国家规定享受基本医疗保险待遇；未达到国家规定年限的，可以缴费至国家规定年限。
