释义	精神病人的法定监护人为其配偶、父母、成年子女、其他近亲属，指定监护人时，应依其法定监护人的顺序为之。若只有唯一法定监护人，可以向精神病人的所在单位或住所地的居民委员会、村民委员会反映，由上述组织从近亲属中指定监护人。对上述组织指定不服的，可以向人民法院起诉，由人民法院指定监护人。《婚姻法》第二十条夫妻扶养义务夫妻有互相扶养的义务。一方不履行扶养义务时，需要扶养的一方，有要求对方付给扶养费的权利。
