用人单位自什么起即与劳动者建立劳动关系？

劳动关系是现代社会最基础的经济关系，它是指用人单位招用劳动者为其成员，劳动者在用人单位的管理下提供有报酬的劳动而产生的权利义务关系。劳动关系需同时符合以下三个条件：一是组织性，即用人单位招用劳动者，劳动者成为用人单位组织的成员；二是从属性，即劳动者在用人单位的管理、指挥、监督下提供劳动；三是有偿性，用人单位对劳动者提供劳动须支付劳动报酬。
