释义	法律分析：按揭房不能赠与子女，因为房屋仍处于抵押状态中，也就是说赠与人并不算该房屋的所有权人，也无法出示合法的房屋权属证明，未得到银行同意的情况下，不得将房屋出售或者赠与给他人，需先将银行贷款还清，并办理解压手续，才能办理房屋赠与手续。法律依据：《中华人民共和国民法典》第二百零九条不动产物权的设立、变更、转让和消灭，经依法登记，发生效力；未经登记，不发生效力，但是法律另有规定的除外。依法属于国家所有的自然资源，所有权可以不登记。
