释义	《劳动法》第九十条用人单位违反本法规定，延长劳动者工作时间的，由劳动行政部门给予警告，责令改正，并可以处以罚款。《违反；《劳动法》；行政处罚办法》第五条用人单位每日延长劳动者工作时间超过三小时或每月延长工作时间超过三十六小时的，应给予警告，责令改正，并可按每名劳动者每超过工作时间一小时罚款一百元以下的标准处罚。法律依据《劳动法》第九十条
