释义	用人单位拒不履行人民法院已经发生法律效力的执行裁定的，可以对其主要负责人或者直接责任人员予以罚款、拘留；构成犯罪的，依法追究刑事责任。当事人对发生法律效力的劳动仲裁裁决书，应当依照规定的期限履行。【法律依据】《中华人民共和国刑法》第三百一十三条对人民法院的判决、裁定有能力执行而拒不执行，情节严重的，处三年以下有期徒刑、拘役或者罚金；情节特别严重的，处三年以上七年以下有期徒刑，并处罚金。单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。
