释义	法律分析：作出政务处分决定前，监察机关应当将调查认定的违法事实及拟给予政务处分的依据告知被调查人，听取被调查人的陈述和申辩，并对其陈述的事实、理由和证据进行核实，记录在案。被调查人提出的事实、理由和证据成立的，应予采纳。不得因被调查人的申辩而加重政务处分。法律依据：《中华人民共和国公职人员政务处分法》第五十条监察机关对经各级人民代表大会、县级以上各级人民代表大会常务委员会选举或者决定任命的公职人员予以撤职、开除的，应当先依法罢免、撤销或者免去其职务，再依法作出政务处分决定。
