窝藏和包庇罪的区别是什么 |

法律分析：一、定义不同：
窝藏罪：是指明知是犯罪的人但仍然为其提供隐藏处所、财物，还帮助其逃匿的行为。
包庇罪：是指明知是犯罪的人但仍然作假证明给以包庇的行为。
二、客观表现不同：
窝藏罪：客观上表现为为罪犯提供隐蔽处所或用金钱、物质资助罪犯逃往他处隐蔽的行为。窝藏的对象必需是已经实施犯罪或越狱脱逃的罪犯。事先有通谋而事后予以窝藏的，以共犯论处。
包庇罪：客观方面表现为向司法机关或有关组织作虚假证明，或者帮助其隐匿、毁灭罪证、湮灭罪迹，借以帮助犯罪分子掩盖犯罪事实，逃避法律制裁。
三、主观要件不同：
窝藏罪：在开始实施窝藏行为时明知是犯罪的人，或是在开始实施窝藏时，不明知是犯罪的人，但发现对方是犯罪的人后仍然继续实施窝藏行为的，构成本罪，过失不构成窝藏罪。
包庇罪：在开始实施窝藏、包庇行为时明知是犯罪人的，当然成立本罪；在开始实施窝藏、包庇行为时不明知是犯罪人，但发现对方是犯罪人后仍然继续实施窝藏、包庇行为的，也成立本罪。
法律依据：《中华人民共和国刑法》 第三百一十条 明知是犯罪的人而为其提供隐藏处所、财物，帮助其逃匿或者作假证明包庇的，处三年以下有期徒刑、拘役或者管制；情节严重的，处三年以上十年以下有期徒刑。
犯前款罪，事前通谋的，以共同犯罪论处
