释义	1、一般合同上约定的定金是不能退的。2、因为给付定金的一方不想继续履行合同的，法律规定其无权要求退还定金；但是如果是收受定金的一方不履行合同义务，导致合同无法继续履行的，则定金可以退，且应当双倍退还；或者因为不可归责与双方当事人的原因导致合同无法继续履行的，定金也是可以退的。法律依据《中华人民共和国民法典》第五百八十七条
