子公司倒闭员工应该怎么办 |

1、单位被依法宣告倒闭破产的;用人单位被吊销营业执照、责令关闭、撤销或者用人单位决定提前解散的，用人单位应当向劳动者支付经济补偿。2、单位因劳动合同的解除或终止需要向劳动者给予经济补偿时，其标准为：按劳动者在本单位工作的年限，每满一年支付一个月工资。六个月以上不满一年的，按一年计算;不满六个月的，支付半个月工资。3.用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。在公司倒闭解散后要做好善后工作，其中就包括对员工的经济赔偿。法律依据：《中华人民共和国企业破产法》第一百一十三条 破产财产在优先清偿破产费用和共益债务后，依照下列顺序清偿：(一)破产人所欠职工的工资和医疗、伤残补助、抚恤费用，所欠的应当划入职工个人账户的基本养老保险、基本医疗保险费用，以及法律、行政法规规定应当支付给职工的补偿金;(二)破产人欠缴的除前项规定以外的社会保险费用和破产人所欠税款;(三)普通破产债权。破产财产不足以清偿同一顺序的清偿要求的，按照比例分配。破产企业的董事、监事和高级管理人员的工资按照该企业职工的平均工资计算。
