释义	1、未按合同约定支付使用费或者不补交未交的使用费或者不支付违约金。应承担补足应交纳的费用和违约金，拒不支付的，应退还出让方提供的技术资料，停止实施专利或者技术秘密并赔偿因此而给出让方造成的损失。 2、超越约定范围使用专利和技术秘密，擅自许可第三人使用专利和技术秘密，停止违约行为，并承担支付违约金或者赔偿责任。 3、违反约定的保密义务，如泄露技术秘密，转授使用方法等给转让方造成损失，应支付违约金或者赔偿损失。
