释义	法律分析: 目前我国有对合同保证金作出规定的法律是合同法、招标投标法等，进行招标活动时，招标人有权要求投标人交纳履约保证金，而签订买卖合同时，卖方有权要求买方交定金法律依据: 《中华人民共和国招标投标法》第六十条中标人不履行与招标人订立的合同的，履约保证金不予退还，给招标人造成的损失超过履约保证金数额的，还应当对超过部分予以赔偿;没有提交履约保证金的，应当对招标人的损失承担赔偿责任。
