释义	报复陷害他人构成报复陷害罪，正唤犯本罪的，处二年以下有期徒刑或者拘役；举陪凯情节严重的，处二年以上七年以下有乱芦期徒刑，所谓情节严重，是指致使被害人的人身权利、民主权利或其他权利受到严重损害的：手段恶劣的；致使被害人精神失常、自杀的；引起公众不满的；造成恶劣的社会影响的等等。法律依据：《中华人民共和国刑法》第二百五十四条国家机关工作人员滥用职权、假公济私，对控告人、申诉人、批评人、举报人实行报复陷害的，处二年以下有期徒刑或者拘役；情节严重的，处二年以上七年以下有期徒刑。
