问题	如何判定酒后肇事逃逸
释义	法律分析：饮酒后或者醉酒驾驶机动车发生重大交通事故，构成犯罪的，依法追究刑事责任。重大交通事故是前提，构成犯罪是统称。这是刑法修订后给予执法者自由裁量的重要改变。这里没有讲“肇事”，就是将酒后、醉驾从交通肇事罪中否认出来，排除了“交通肇事过失犯罪”。所谓构成犯罪是以行为人主观构成和客观结果论的诠释。法律依据：《中华人民共和国刑法》第一百三十三条交通运输肇事后逃逸或者有其他特别恶劣情节的，处三年以上七年以下有期徒刑；因逃逸致人死亡的，处七年以上有期徒刑。
