释义	法律分析：如果由于土地存在争议、纠纷等问题导致土地未能确权登记，待争议解决之后，将可以进行确权登记。但如果是存在以下三类情况，将不予确权，土地将会被收回：1、未经许可开荒的土地；2、违法占用耕地、基本农田作为宅基地建房；3、废弃、闲置宅基地。法律依据：《中华人民共和国民法典》第三百四十九条设立建设用地使用权的，应当向登记机构申请建设用地使用权登记。建设用地使用权自登记时设立。登记机构应当向建设用地使用权人发放权属证书。
