释义	缔约过失责任属于过错责任。根据法律规定，构成缔约过失责任的条件之一是缔约过失人在主观上必须存在过错。如果另一缔约人的损失非因对方的过错而是由其它原因造成的，其不得向对方主张缔约过失责任，如不可抗力致使合同无法顺利订立时就不存在缔约过失。这里的过错既包括故意，也包括过失。法律依据《中华人民共和国民法典》第一百八十条、第五百条、第五百九十条
