释义	甲与乙有实际交易，甲开出空白收款人的支票付款。乙收到票据后依次转让给丙，丙转让给丁，均没有背书。丁收到支票后，在收款人位置填写自己的名称，并向银行提示付款。因银行账户余额不足，被银行退票。丁遂起诉甲，要求甲承担付款义务，但甲辩称其与丁没有实际交易，丁取得票据违反《票据法》关于取得票据应具有真实交易关系的规定，丁与甲之间也没有给付对价，因此不得享有票据权利。丁最后只能按真实交易关系向丙主张权利。
