法律分析:
雇佣劳动者，草拟劳动合同应当具备以下内容：
1、劳动者基本信息（包括姓名、住址和居民身份证或者其他有效身份证件号码）；
2、用人单位基本信息（包括名称、住所和法定代表人或者主要负责人）；
3、劳动合同期限（固定期限、无固定期限、已完成一定任务为期限）；
4、工作内容和工作地点；
5、工作时间和休息休假（是否为8小时工作制，周休1天还是2天等）；
6、劳动报酬（工资支付方式、支付时间、支付对象、特殊情况下的工资支付等）；
7、社会保险（养老保险、医疗保险、工伤保险、失业保险、生育保险）；
8、劳动保护、劳动条件和职业危害防护；
9、其他事项。
以上为劳动合同必备条款，除此之外，用人单位与劳动者还可以约定竞业限制、保密义务、服务期、试用期等条款。《中华人民共和国劳动合同法》第十七条
劳动合同应当具备以下条款：
（一）用人单位的名称、住所和法定代表人或者主要负责人；
（二）劳动者的姓名、住址和居民身份证或者其他有效身份证件号码；
（三）劳动合同期限；
（四）工作内容和工作地点；
（五）工作时间和休息休假；
（六）劳动报酬；
（七）社会保险；
（八）劳动保护、劳动条件和职业危害防护；
（九）法律、法规规定应当纳入劳动合同的其他事项。
劳动合同除前款规定的必备条款外，用人单位与劳动者可以约定试用期、培训、保守秘密、补充保险和福利待遇等其他事项。
