释义	法律分析：如果考公检法公务员的,近亲属、近姻亲、对本人有重大影响的旁系亲属等正在服刑的,政审不能通过。如果不是公检法公务员,但是上述人员凡有危害国家安全、组织参与恐怖活动、组织参加邪教组织和活动,被判处刑罚的,政审不合格。法律依据：《中华人民共和国公务员法》第二十六条下列人员不得录用为公务员：（一）因犯罪受过刑事处罚的；（二）被开除中国共产党党籍的；（三）被开除公职的；（四）被依法列为失信联合惩戒对象的；（五）有法律规定不得录用为公务员的其他情形的。
