释义
构成战时自伤罪一般会判处三年以下有期徒刑。本罪指军职人员在战争情况下或者在部队接受作战任务进行战斗动员后，由于畏惧战斗，贪生怕死，用自伤身体的手段逃避军事义务的行为。在战时，对被判刑三年以下有期徒刑没有现实危险宣告缓刑的犯罪军人，允许其戴罪立功，确有立功表现的，可以撤销原判刑罚，不以犯罪论处。
法律依据：
《中华人民共和国刑法》 第四百三十四条 战时自伤身体，逃避军事义务的，处三年以下有期徒刑；情节严重的，处三年以上七年以下有期徒刑。
