释义	法律分析：国法律规定民间借贷的利息由双方约定，借贷双方约定的利率超过年利率36%，超过部分的利息约定无效。民间借贷的利息由双方约定，但超过同期银行贷款利率四倍的，不受法律保护，也就是说如果借钱的人不还钱，债权人起诉到法院，法院判决的话，只会按照同期银行贷款利率的四倍判决利息，超出的不判。法律依据：《中华人民共和国民法典》第六百七十条借款的利息不得预先在本金中扣除。利息预先在本金中扣除的，应当按照实际借款数额返还借款并计算利息。
