释义	法律分析：刑罚分为主刑和附加刑。主刑包括管制、拘役、有期徒刑、无期徒刑、死刑。附加刑包括罚金、剥夺政治权利、没收财产。附加刑也可以独立适用。量刑必须以刑法为准绳，是指人民法院在认定犯罪事实的基础上，必须按照刑法的有关规定对犯罪分子是否判刑、判什么刑、判刑轻重以及如何执行刑罚作出判处。法律依据：《中华人民共和国刑法》第三十三条主刑的种类如下：（一）管制；（二）拘役；（三）有期徒刑；（四）无期徒刑；（五）死刑。
