释义	法律分析：一般具有同等的法律效力，但是如果当事人或者公司章程另有约定的除外。如果协议有明确条款说明盖章后生效，但只有法人代表签字，没盖公章，协议还不能生效。没有这个盖章后生效的条款，双方有法人代表签字，没盖公章，协议就已经生效。法律依据：《中华人民共和国公司法》第三条公司是企业法人，有独立的法人财产，享有法人财产权。公司以其全部财产对公司的债务承担责任。有限责任公司的股东以其认缴的出资额为限对公司承担责任份有限公司的股东以其认购的股份为限对公司承担责任。
