释义	法律分析：刑事判决一般在过了上诉期后就生效。一审刑事案件宣判后，判决书送达当事人的第二日起十日内为上诉期。上诉期内一审判决书的效力待定。案件经过二审后，如果二审裁定维护原判决，该二审裁定书为终审裁定，送达后即发生法律效力。法律依据：《中华人民共和国刑事诉讼法》第二百三十条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。第二百四十四条第二审的判决、裁定和最高人民法院的判决、裁定，都是终审的判决、裁定。
