释义	个人和用人单位都可以按照法律规定的流程进行工伤等级和劳动能力鉴定。但若未被认定为是属于工伤的册纯塌，则劳动能力鉴定委员会不接受鉴定申请。职工有因犯罪或者违反治安管理伤亡的；醉酒导致伤亡的；自残或者自杀情形的，不得认定为工伤或者视同工伤。法律依据:《工伤保险条例》第二十一条职工发生工伤，经州圆治疗伤情相对稳裤携定后存在残疾、影响劳动能力的，应当进行劳动能力鉴定。
