释义	法律分析：提起上诉的，法院可以开庭审理案件，也可以决定不开庭审理，如果不开庭审理案件的，法院要听取他当事人、辩护人、诉讼代理人的意见。如果开庭审理案件的，要在二个月内作出宣判。法律依据：《中华人民共和国民事诉讼法》第一百六十九条第二审人民法院对上诉案件，应当组成合议庭，开庭审理。经过阅卷、调查和询问当事人，对没有提出新的事实、证据或者理由，合议庭认为不需要开庭审理的，可以不开庭审理。第二审人民法院审理上诉案件，可以在本院进行，也可以到案件发生地或者原审人民法院所在地进行。
