释义	劳务关系不能认定工伤，但可以按照人身损害案件进行索偿。除了劳动者与用人单位形成具有一定人身依附性的劳动关系外，还经常出现劳务关系，劳务关系的雇主不限于用人单位，也可能包括个人，雇工不限于劳动法意义上的劳动者，也包括超过法定退休年龄的人员等。法律依据：《工伤保险条例》第三十条：职工因工作遭受事故伤害或者患职业病进行治疗，享受工伤医疗待遇。职工治疗工伤应当在签订服务协议的医疗机构就医，情况紧急时可以先到就近的医疗机构急救。
