释义	法律分析：被继承人生前的债务，如果是个人债务的，由其遗产偿还；被继承人所欠下的债务，虽是以被继承人名义欠下，但是实际上是用于家庭共同生产生活的，就不能认定为是被继承人的个人债务，而应作为家庭债务，由家庭成员共同负担。法律依据：《中华人民共和国民法典》第一千一百六十一条继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
