释义	法律分析：服役期间近亲属犯罪被判刑的，只要与本人无关的，当然不会除名或开除军籍。法律依据：《中国人民解放军纪律处分条令》第四十二条对违反纪律，有下列情形之一的，应当开除军籍：（一）已构成危害国家安全罪的；（二）故意犯罪，被判处五年以上有期徒刑、无期徒刑、死刑的；（三）被判处有期徒刑不满五年的人员或者过失犯罪被判处五年以上有期徒刑的人员在服刑期间，或者被劳动教养的人员在劳动教养期间，抗拒改造，情节严重的；（四）违反纪律，情节严重，影响恶劣，已丧失军人基本条件的。
