释义	律师解答：不可以拍卖。尚未支付的购房款是破产财产(债权)。房屋买卖合同已经生效，且已经在房管局备案的，合同继续有效，双方都应当继续履行合同的约定。此时，购买方尚未交付的房款，属于开发商的债权。【法律依据】：《中华人民共和国破产法》第二条企业法人不能清偿到期债务，并且资产不足以清偿全部债务或者明显缺乏清偿能力的，依照本法规定清理债务。企业法人有前款规定情形，或者有明显丧失清偿能力可能的，可以依照本法规定进行重整。
