法律主观：
发了货不付款不一定属于诈骗。一般情形下属于违约行为，是民事纠纷，另一方应承担继续支付、赔偿损失的民事责任；但如果不付款的一方在购货时有诈骗目的，拒不付款的，数额达到三千元及以上的，可构成诈骗罪。
