释义	交付房屋不符合商品房预售合同中的约定，应由开发商向业主承担违约责任。交付房屋改变的建筑事项，无论是否经过行政机关审批或者是否符合建筑规范，均属另一法律关系，不能成为开发商不违约或者免除违约责任的理由。法律依据: 《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救方法或者赔偿损失等违约责任。
