释义	当夫妻一方没有固定收入和缺乏生活来源，或者无独立生活能力或生活困难，或因患病、年老等原因需要扶养，另一方不履行扶养义务时，需要扶养的一方有权依据我国《婚姻法》第二十条之规定通过诉讼程序要求对方承担扶养责任。《婚姻法》第四条家庭关系夫妻应当互相忠实，互相尊重；家庭成员间应当敬老爱幼，互相帮助，维护平等、和睦、文明的婚姻家庭关系。第二十条夫妻扶养义务夫妻有互相扶养的义务。一方不履行扶养义务时，需要扶养的一方，有要求对方付给扶养费的权利。
