释义	根据规定，空头支票被禁止签发。出票人签发一张支票，如果账户余额不够支付所签发支票的金额，该支票就是一张空头支票。另外，与预留银行签章不符的支票，也被视为空头支票。同时，签发空头支票将依法受到处罚。对于签发空头支票或者与其预留的签章不符的支票，不以骗取财物为目的的，出票人将被处以支票票面金额5%但不低于1000元的罚款，持票人还有权要求出票人赔偿支票票面金额2%的赔偿金；以骗取财物为目的的，出票人还将被追究刑事责任。法律依据《票据管理实施办法》第三十一条
