释义	法律分析：在发生事故之后是根据伤者的意愿申请进行伤残鉴定的，如果是工伤事故的话，在认定为工伤两年之后是不能进行劳动能力鉴定的。法律依据：依据《劳动能力鉴定管理办法》第八条，提出申请职工发生工伤，经治疗伤情相对稳定后存在残疾、影响劳动能力的，用人单位、工伤职工可以向设区的市级劳动能力鉴定委员会提出初次劳动能力鉴定申请。申请劳动能力鉴定的时限自作出工伤认定结论之日起最长不超过2年。工伤职工本人无法提出申请的，可由其近亲属代为提出。
