释义	法律分析：如果是自己的承包地，是可以出租的，该出租就是承包土地的流转，是合法的，受到法律保护。但是，流转后的土地，不得改变土地的性质和用途。如果是在承包地上建筑，是改变了土地的性质，属于非法建筑，也是违法的。法律依据：《中华人民共和国农村土地承包法》第五十三条通过招标、拍卖、公开协商等方式承包农村土地，经依法登记取得权属证书的，可以依法采取出租、入股、抵押或者其他方式流转土地经营权。
