释义	依据我国劳动合同法的规定，童工是指未满16周岁的未成上人，用人单位招聘童工的，不会形成事实劳动关系，童工不属于劳动者。《中华人民共和国劳动法》第十五条禁止用人单位招用未满十六周岁的未成年人。文艺、体育和特种工艺单位招用未满十六周岁的未成年人，必须依照国家有关规定，履行审批手续，并保障其接受义务教育的权利。第九十四条用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款情节严重的，由工商行政管理部门吊销营业执照。
