释义	法律分析: 员工拒绝转岗，分以下情形处理：胜任现在工作且拒绝转岗的，按原劳动合同履行；在试用期间被证明不符合录用条件的且拒绝转岗的，直接开除；不能胜任工作，经过培训或者调岗，仍不能胜任工作的，无过失性辞退。《中华人民共和国劳动合同法》第三十五条用人单位与劳动者协商一致，可以变更劳动合同约定的内容。变更劳动合同，应当采用书面形式。变更后的劳动合同文本由用人单位和劳动者各执一份。
